GENERAL TERMS AND CONDITIONS FOR HAI! REWARDS OVERVIEW Signing up with Hai! Rewards and being a part of the Hai! Platform will give the Member access to the following privileges: a. earn points through their purchases from multiple partner merchants; and, b. with these points, redeem rewards from any partner merchant as long as they are part of the platform. SIGNING UP AND BECOMING A HAI! MEMBER To become a Hai! Member, registration must be completed through https://haiphilippines.com. A user must enter the following information to complete their registration. a. First Name b. Last name c. A valid e-mail address d. Mobile number e. Password f. Referral code (optional and as may be provided by another Hai! Member) Once the foregoing information are provided, user is able to enter the website. Before accessing anything, the Hai! Member will need to enter a verification code that verifies their mobile number and email address. If these are not verified, the Hai! Member will not be able to earn their points and redeem rewards in the Catalog. Only one account is allowed for each Hai! Member and for which, only one valid email shall be used. Hai! Rewards reserves the right, in its sole discretion, to automatically deactivate, shut down, and/or cancel a Hai! Member’s account which has an indication of being spurious and fraudulent. For this purpose, the following cases are deemed as an indication of a fake, spurious, or fraudulent account: a. Use of disposable email address; b. Use of dummy accounts to farm points and rewards items c. Violation of any of the terms and conditions as herein provided; and, d. Other similar and/or analogous cases, as may be determined by the Hai! Team. EARNING POINTS Hai! Members can earn points through many ways: Updating of profile. Upon registering to the Hai! platform, the Hai! Member can earn points through updating their profile. Purchasing from partner merchants. Partner merchants are establishments who award Hai! Points to their users. There is no fixed amount of points per partner merchant since each establishment comes up with their own rules and mechanics for dispensing points. Referring friends. To refer a friend, a Hai! Member must enter their friends’ email addresses in the “Refer a Friend” section of the website. Clicking Send will trigger an email to be sent to the email addresses entered. This email will contain a unique referral code. When used by the aforementioned friend during registration to Hai! Rewards, both the new member (friend) and the original Hai! Member will earn points. Engaging on social media. The Hai! Rewards Facebook page holds contests and social media games from time to time as a way for Hai! members to earn more points. Hai! members who want to earn points easily should stay tuned to the page for the next new game. Liking and sharing posts and pages. Hai! members can also earn when they Like and Share posts and pages being featured on the Hai! Website. These can be found on the “Earn More Points” section of the website. Scanning QR codes. QR codes can be found on ads being displayed on the Phone2Prints kiosk ad screens. Scanning these QR codes can earn a Hai! member points for every scan depending on the mechanics of the QR code promo. Answering surveys. Hai! embers can earn points when they answer surveys. These surveys are sent to Hai! Members through the Hai! Facebook page, through QR codes displayed on ad screens, or through email and SMS blasts. A Hai! Member’s survey answer will only be counted once. This means that a Hai! Member is only allowed to earn points from the same survey once. Awarding of points vary depending on the type of survey, length, questions, and the members’ response. Entering promo codes. Promo codes can be used on the Earn More Points section of the website. When entered, a Hai! Member can earn points. The amount of points earned and the validity of the promo code depends on how it is set up. Promo codes can be found on the Hai! Social media page. These can also be used at events or by partners to easily dispense points. Birthday points. Hai! Members can earn points every year as a birthday gift from Hai!; provided, that: Hai! Member must have been a member for at least 30 days to earn their points. User can only change their date of birth once in every 12 months. Points are non-transferrable. Hai! Member must be careful in providing their Hai! verified email/mobile numbers to avoid their points being credited to the wrong person. Upon receiving points, a Hai! Member will receive an SMS and/or email notification. This notification will indicate the following information: Points earned; Merchant; Date awarded; and, Notification/instruction on how to access their points and a link to the Hai! Rewards website. Hai! Rewards reserves the right to change the points system, at its sole discretion; provided, that its website be updated with the amended points system. The amended points system shall be effective immediately upon posting in the website. Points are valid for 6 to 12 months. If user earns points from January to June, their points will expire in December of that year. Meanwhile, points earned from July to December expire in June of the next year. REDEEMING REWARDS Hai! Members can use their points to redeem rewards items that are available on the Hai! Rewards Catalog, as can be found on https://haiphilippines.com. Depending on the item, items can be delivered to the Hai! Member through the following channels: SMS (mobile load). Mobile load rewards are sent to an account’s registered mobile number. Hai! Rewards’ website states that load items will be delivered at least 3 days from the time of redemption, which may be extended depending on the volume of redemptions made. Email delivery (gift certificates). Digital rewards items can be delivered to a Hai! Member through their registered email address. Hai! Rewards’ website states a generous lead time of 7 days from the time of redemption, which lead time may be extended depending on where Hai! will be sourcing the item.. Delivery to home/office (physical items). Physical items can be delivered to the address indicated in the Hai! Member’s profile as long as it is located in Metro Manila. Delivery is to be fulfilled by Hai!’s courier service. Delivery time varies due to different suppliers, but typically takes 7 days from the day of order being made, which may be extended depending on the volume of deliveries being made. Claim from partner merchant. Partner merchants are given the opportunity to include their products and services on the Rewards Catalog. In line with this, items redeemed from the Rewards Catalog can be claimed directly at the merchant’s store, whether online or offline. Hai! Members just need to present their redemption code to the merchant in order to avail their item. Hai! Members must ensure that the correct information is provided on their profile to ensure that their reward is delivered to them efficiently. Hai! Members must also remember that Hai! points are non-refundable so they must take extra care when they redeem items from the catalog. Hai! Rewards reserves the right to change the rewards system, at its sole discretion; provided, that its website be updated with the amended rewards system. The amended rewards system shall be effective immediately upon posting on the website. The Hai! Team reserves the right, in its sole discretion, to not fulfill a Hai! Member’s reward order if such member is found to be using fake, spurious, or fraudulent account, as defined above. Fake, spurious, or fraudulent accounts shall be permanently banned from the platform. PERSONAL DATA The Hai! Team is committed to protecting the privacy of its Hai! Members. The personal data collected by the Hai! Team in this system shall be used exclusively in compliance with the data privacy laws of the Philippines. The Hai! Team shall not use the personal data gathered pursuant to this agreement for any other purpose other than to provide services and extend promotional offers to its Hai! Members. The Hai! Team shall take appropriate technical and organizational measures to protect such personal data. The Hai! Member represents and warrants that it accepts the gathering of his/her private information consisting of, but not limited to, his/her full name, mobile number, and email address, in order to provide access to The Hai! Rewards features. The Hai! Member shall be responsible for the accuracy, quality, and legality of his/her data and of the means by which he/she acquired his/her data. By accepting these General Terms and Conditions, the Hai! Member gives the Hai! Team permission to use his/her personal data for personalized offers. The Hai! Member also gives permission to communicate with him via all possible media, including email and text messages. The data are used by the Hai! Team and the companies affiliated with it for managing memberships, promotional purposes, sales and market analyses, and for any other legitimate purposes. The Hai! Member also understands that behavioral data may also be collected in the course of his use of services. Accordingly, the Hai! Member’s personal data may be disclosed to affiliate companies of the Hai! Team or third parties. After termination of membership, the Hai! Member shall no longer receive promotional offers from the Hai! Team. The Hai! Team shall store Hai! Member’s personal data for the entire duration of the membership and for three (3) months after its termination. During such period, a personal information controller shall implement reasonable and appropriate organizational, physical, and technical measures intended for the protection of personal information against any accidental or unlawful destruction, alteration and disclosure, as well as against any other unlawful processing. The Hai! Member shall be responsible for guarding his/her account credentials to prevent unauthorized access or use of the Hai! Rewards services and shall notify the Hai! Team of any such unauthorized access or use. The Hai! Member shall use the Hai! Rewards services only in accordance with applicable laws and government regulations. If the Hai! Member should have concerns as to the protection of his personal data, he may contact the Hai! Team’s personal information controller by sending an email to email@example.com. The Hai! Team also recognizes the right of the Hai! Member to file a complaint before the National Privacy Commission in case of breach of the provisions of the Data Privacy Act of 2012. SERVICE AVAILABILITY The Hai! Team shall use reasonable endeavors to make available to its Hai! Member at all times the services but it shall not, in any event, be liable for interruptions of services. The Hai! Team shall have the right to suspend the services at any time and for any reason, generally without notice, but if such suspension lasts or is to last more than 7 days, the Hai! Member will be notified of the reason. TERMINATION OF MEMBERSHIP Hai! Membership can be ended by the Hai! Member at any time, with or without justification, to the Hai! Team through firstname.lastname@example.org, without right to refund all points that may have accrued to the account. INQUIRIES AND CONCERNS A Hai! Member can submit their inquiries in the Hai! Rewards’ website, e-mail at email@example.com, or Facebook account. The Hai! Team undertakes to address the Hai! Member’s inquiries and concerns as soon as practicable. NOTICES All notices relative to the membership shall be sent to the Hai! Member’s email address provided during the registration process. APPLICABLE LAWS Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of the Philippines. AMENDMENTS These terms and conditions may be amended at any time by posting a revised version on https://haiphilippines.com. The revised version shall be effective at the time of posting. ENTIRE AGREEMENT By clicking accept, you hereby agree to the aforementioned terms and conditions which constitute the sole record of the agreement between the Hai! Member and the Hai! Team in relation to the Hai! Member’s use of the system. Neither the Hai! Member nor the Hai! Team shall be bound by any express or implied representation, warranty, promise, or the like not recorded herein. Unless otherwise specifically stated, these terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between the Hai! Member and the Hai! Team with respect of the use of the system.
